Comentários: a audiência de instrução deve ser, tanto quanto possível, una, ou seja, indivisível, no sentido de que, uma vez instalada, deve abarcar todos os atos que a envolvam, sobretudo o que diz respeito à prova oral, a ser produzida, em condições ideais, em uma só audiência. Com isso, busca o Legislador evitar qualquer interferência de fatores externos sobre conteúdo da prova oral, o que poderia ocorrer se houvesse cisão na produção desse tipo de prova.
Mas há situações que poderão impor a necessidade de que a audiência seja cindida, quando, por exemplo, nem todas as testemunhas estejam presentes ao ato e possam naquele momento ser ouvidas, obrigando o juiz a realizar uma audiência em continuação. Obviamente, esse risco foi previsto pelo Legislador.
